GENERAL CONDITIONS OF SALE GRIBOUILL.ART

ARTICLE 1 -DEFINITIONS

The CUSTOMER designates the signing company or person. Gribouill.art designates the commercial name of the company SGFC, SARL.

ARTICLE 2 - PURPOSE

The purpose of these general conditions of sale, hereinafter referred to as “CGV”, is to define the conditions under which Gribouill.art carries out its services.

They constitute a contract for the provision of a service or sale or rental, concluded when subscribing to one or more services or when purchasing products, between the CUSTOMER and the company Gribouill.art.

Any service performed by the company Gribouill.art, after signing a contract, a purchase order or a quote, implies the customer's adherence and acceptance, without reservation, of these general conditions of sale.

ARTICLE 3 - RIGHT TO APPLY THE SERVICE

These General Terms and Conditions are applicable to all services and products provided by Gribouill.art. And take precedence over any document issued such as quotes, purchase orders, invoices or your own general conditions of purchase.

However, certain products or services may benefit from special conditions.

These special conditions, if they exist, do not result in the nullity of these General Terms and Conditions.

If an article of said special conditions comes into disagreement or conflict with these T&Cs, this article would then take precedence over these T&Cs.

Any general conditions of sale, rental or purchase contrary to the Customer are unenforceable against Gribouill.art, even when the latter is aware of them.

ARTICLE 4 - SERVICE AND GUARANTEE

Gribouill.art undertakes to implement all necessary measures to provide services to the Client in accordance with the contract signed by the Client.

Gribouill.art undertakes, in its sole discretion and to the extent permitted by applicable law, to repair, maintain, manage or, if necessary, replace any product or service covered by Gribouill.art.

These conditions of use and our company are subject to technical measures in this sense and human.

ARTICLE 5 – INTERRUPTION OF THE SERVICE FOR HARDWARE OR SOFTWARE MAINTENANCE OF THE SERVER

Gribouill.art may be required to carry out maintenance or development operations likely to affect or interrupt the operation of the service. Gribouill.art will inform the CUSTOMER of such operations by any means with reasonable notice depending on the emergency case and for interventions lasting more than fifteen minutes. Gribouill.art will endeavor to limit the consequences on the service. Maintenance periods are always considered, whatever their nature, as periods of availability.

ARTICLE 6 -LIMITATION OF LIABILITY

Gribouill.art cannot under any circumstances be held responsible for damage attributable to external causes (partial or total failure of the Internet network or its own operators and service providers) and in particular in the event of force majeure (strike or disruption , in particular postal services and means of transport and/or communication, flood, fire, etc.).

Gribouill.art, its employees and subcontractors, cannot under any circumstances be held responsible, with regard to the CLIENT or any sub-purchaser or user whatsoever, for direct or indirect damage linked to the execution of the contract, including, but not limited to, costs relating to the recovery, reprogramming or reproduction of any software or data, the inability to maintain the confidentiality of data, any loss of commercial opportunity, turnover, profit, or expected savings.

To the fullest extent permitted by applicable law, the liability of Gribouill.art, its employees or its subcontractors, due to the implementation of the CONTRACT, cannot exceed the price paid by the CLIENT to benefit from this CONTRACT. Especially,

Gribouill.art does not guarantee that it will be possible to repair or replace the covered product or service without risking loss or damage to the software or data contained in the covered product or service.

The liability of Gribouill.art is limited, at its sole discretion and taking into account the use made of it, to the replacement, administration or repair of the covered product or service.
